TERMS AND CONDITIONS OF THE PINS PROGRAM (updated on 03.04.2018)

Definitions

1.1 PINS.CO - SIA PINS.CO (Registration Number: 40103273540, address: Mukusalas 42, Riga, LV-1004, Latvia) and PINS Finland Oy (Business ID: 2559717-3, address: Tekniikantie 14, FI-02150 Espoo, Finland) jointly.

1.2 Program - PINS loyalty program created by PINS.CO and offered and maintained in Finland by PINS Finland Oy.

1.3 PINS - Units which can be collected under the Program for the purpose of purchasing goods/services from the Partners as well as exchanged for goods/services offered as part of the Program.

1.4. airBaltic (AS Air Baltic Corporation, Reg. No. 40003245752) - PINS loyalty program partner.

1.5. “Status PINS” are PINS, which you can only earn when flying with airBaltic.

1.6 Terms and Conditions - These terms and conditions governing the Program rules and procedures that are binding on the Program Members and Partners.

1.7 Online Service - An online service created by PINS.CO, located at www.pins.fi and designed for the Program Members for the purpose of creating online profiles and using account information.

1.8 PINS Mobile App (PINS App) - Program Mobile Application created by PINS.CO, designed to run on mobile devices for the Program members to create their online profiles and to use their account information.

1.9 PINS Member or Member - A person who has acceptably enrolled to the Program and who has agreed to these Terms and Conditions. The enrolment can be done by the person himself or it can be done on his behalf by his lawful representative with the right to do it.

1.10. “PINS VIP Member” or “VIP Member” is a member of PINS, who during the term of one year has made 60 one-way flights with airBaltic or earned 50,000 status PINS, thus receiving the status of a VIP Member, which is subject to all the rules applicable to PINS Members, unless otherwise specified.

1.11. “PINS Executive Member” or “Executive Member” is a member of PINS, who during the term of one year has made 30 one-way flights with airBaltic or earned 25,000 status PINS, thus receiving the status of an Executive Member, which is subject to all the rules applicable to PINS Members, unless otherwise specified.

1.12 PINS Account or Account - An account opened for a PINS member after enrolment for the registration of the PINS collected and/or spent by the Member. The PINS Account is available on the Member’s online profile on the Program's website or via PINS Mobile App.

1.13 PINS Members' Collective Account or Friends and Family - A group of accounts created in the Online Service, which allows the joining of PINS from several PINS Accounts, thus providing new opportunities for spending PINS.

1.14 PINS Membership Number - The Member's individual identification number displayed on the Card, which is linked to the Account.

1.15 Partner - A PINS.CO Partner who has entered into a contract with PINS.CO or another enterprise authorised to enter into such agreements on behalf of PINS.CO for collecting and/or spending PINS.

1.16 Card A Program membership card with the PINS Membership Number. There are four types of cards:

Personalised Card – PINS Card with the PINS Membership Number, cardholder’s name, and the Program membership level, if applicable.

Non-Personalised Card – PINS Card with the PINS Membership Number.

Temporary Card – paper card printed from the PINS Member’s online profile, accessible via PINS Mobile App or enclosed with the application form. The Temporary card must contain a clearly legible PINS Membership Number.

• Digital card – virtual representation of PINS card which can be used right away after downloading PINS Mobile App.

1.17. “Executive Card” – PINS issued Executive Program member card fitted with a membership No., that allows one to receive PINS and additional privileges using airBaltic services, and is subject to all the rules applicable to the Card, unless otherwise specified.

1.18 “VIP Card” – PINS issued VIP Program member card fitted with a membership No., that allows one to receive PINS and additional privileges using airBaltic services, and is subject to all the rules applicable to the Card, unless otherwise specified.

1.19. Application Form - An online application form filled out in the Program's Online Service, or PINS Mobile App or an application in paper form, or an expression of willingness to participate in the Program registered in the Online Service in some other way.

1 Membership Eligibility Criteria

1.1 In the application form, a person is required to provide accurate and sufficient information. The name and surname indicated in the application must match the details displayed on an identity card (passport, driving licence, ID card).

1.2 Any natural person of full age and capacity may become a PINS member. The participation in the Program of persons who are not of full capacity (such as those who are under 18 years of age or otherwise incompetent), will require the consent of their parents, legal guardians, trustees, or any other person who is legally authorised to represent the incompetent person.

2 Commencement of Membership

2.1 Only individuals who have filled out the Application Form may become Members. Membership will commence from the date of submission of a duly filled-out Application Form.

2.2 By enrolling to the Program, the Member agrees to the Terms and Conditions of the Program. The current version of the Terms and Conditions is available on the Program's website. 

2.3 PINS.CO and PINS Finland are entitled to reject any application to the Program for any reason deemed justified by PINS.CO.

2.4 An issued Card may only be used by the Member or the Member’s lawful representative and the membership is non-transferable.

3 PINS Account

3.1 A PINS Account will be opened for a Member when the PINS Membership has been granted to the Member. A Member is only allowed to hold one PINS Account. If membership is sought by completing a paper form, the Account will be created within three (3) weeks of receiving the membership application. If participation is sought by initial registration form in PINS Mobile App, account is created only after full registration performed via Mobile App.

3.2 If the Member holds more than one PINS Account, PINS.CO has the right to close, without notice, all accounts that have no PINS.

3.3 If the Member has several Accounts which have been awarded PINS, the PINS will be transferred to the PINS Account specified by the Member, which will then become the Member’s permanent PINS Account.

3.4 The Account is connected to the individual email address specified in the Online Service by the Member. The email address may only be registered with a single Account.

3.5 The collected PINS will be available for review in the Online Service or Mobile App. If a Member detects any errors in the account statement, the Member must contact the PINS Customer Service within three (3) months from the date of purchase. After this period the Member is deemed to have accepted the existing Account balance and the data will not be corrected. The contact details of the PINS Customer Service are available on the Program's website.

3.6 PINS Members' Friends and Family Account

3.6.1 The Online Service allows several Members to be joined into a single Account as a group. A Friends and Family Account can be created and new Members can be added to it on the Program's website.

3.6.2 A maximum of eight (8) Members can be joined to a single Friends and Family Account. Each Member can only be part of one Friends and Family Account.

3.6.3 The Member who created the Friends and Family Account also becomes the administrator of the Friends and Family Account, and he will have the right to add other Members to the Friends and Family Account. The Member who created the Friends and Family Account will be responsible for ensuring that he has the right to join other Members to the Friends and Family Account. 

3.6.4 By creating the Friends and Family Account, the administrator of the Account undertakes responsibility for any Account activity, including any activity by the other group Members.

3.6.5 All Members of the Friends and Family Account accrue PINS to the same Friends and Family Account. The administrator of the Friends and Family Account has the right to spend PINS accrued by the other Members for the purpose of redeeming the rewards offered under the Program. The administrator of the Friends and Family Account has the right to authorise any Member of the group to spend the PINS of the Friends and Family Account.

3.6.6 To exclude an Account from the Friends and Family Account, the administrator of the group must contact the PINS Customer Service.

4 PINS Cards

4.1 When a member applies to the Program through one of the Partners, the Member may receive a Non-Personalised Card. For the Member to be registered with the Program, he must activate his card in the Program's Online Service shortly after receiving the Card, after which he will receive an email confirming the activation, or fill out the Application Form enclosed with the Card.

4.2. When applying for the Program via Mobile App, the Member will be authenticated via sms and will receive a Digital card in Mobile App.

4.3. After applying for the Program online, Member can use digital card in the app or if necessary order a plastic card in Members profile. Then Personalized PINS card will be sent to the Member’s address.

5 Accrual of PINS

5.1 In order to collect PINS, the Member must present his PINS Membership Number and/or PINS Card, or any other Card that entitles him to collect PINS when using or purchasing eligible services or goods. PINS.CO will credit the accrued PINS to the Member's account on the basis of the information received from the Program's Partners no later than within a reasonable time after each calendar month. If PINS are not automatically credited to the Member’s account, the Member may claim the missing PINS in the Online Service or by contacting the PINS Customer Service. If the Card or the PINS Membership Number is not presented, no rewards may be received.

5.2 Each Partner will be responsible for its own offers and rewards, and PINS.CO will not be responsible for them. The offers and rewards may be subject to the terms and conditions of the Partner in question.

5.3 No PINS will be awarded for goods/services in respect of which:

5.3.1 the product or service has not been paid for;

5.3.2 their value has been reimbursed or compensated with cash;

5.3.3 their term of validity has expired; or

5.3.4 they have been obtained by illegal means.

5.4 The accrual of PINS from the acquisition of services or products of each Partner depends on the agreement between each Partner and the Program, in which the conditions for the amount of PINS awarded to the Members are defined. Some Partners do not necessarily allow the collection of PINS with a Temporary or Digital Card. The Member's PINS will be recorded in accordance with these Terms and Conditions for all of the Partner's services that are eligible to receive PINS and that have been received between the application to the Program and registration of the PINS Account.

5.5 If a Partner applies program membership levels to the accrual of PINS, the terms and conditions of the Partner will be applied to such an arrangement.

5.6 All notices on other possible ways of accruing PINS not mentioned in these Terms and Conditions will be separately published in the PINS Reports in the Program's Online Service.

6 Spending PINS

6.1 The collected PINS may be spent as soon as the Member's Card has been activated and the amount of PINS required for purchasing the products/services in question has been reached on the Member’s Account and collected PINS have been transferred to the account after the accrual activity.

6.2 The Program gives an opportunity to spend the collected PINS in certain stores and online stores. These stores are listed in the Program's Online Service. By making a purchase, the Member confirms that he has read and agrees to the terms and conditions of the online store.

6.3 PINS.CO does not guarantee the availability of the products/services to be redeemed with PINS.  Further information on the availability of the products/services and special conditions is available on the Program's website or from the Partner.

6.4 After acquiring the product/services in exchange for PINS, or in combination of PINS and money, the supporting documents (award tickets and/or other receipts) will be sent to the address specified by the Member. The documents will be prepared electronically. Information on the return policy and the price of the services is available from various PINS information materials and/or from the Partner. The PINS Customer Services will also reply to any inquiries relating to this.

6.5 If a Member wishes to return a product purchased with the collected PINS, or in combination of PINS and money, and is able to present the required supporting documents, the Member will be credited with the amount of PINS stated in the supporting documents. If a purchase is paid from a Friends and Family Account, PINS will be credited to the Friends and Family Account. The terms and conditions displayed in the Online Service are applied to returns.

7 PINS Validity Period

7.1 PINS are valid for three (3) years, starting from the day of accrual (the day of purchase of an eligible product/service). Periods of validity different to the above may apply to certain PINS accrued from the purchase of the Partners' products or services. Information on the different periods of validity is available on the Program's website and from the Partner. 

 7.2. Status PINS are valid for 365 days from the date on which the airBaltic flight is made.

7.3. PINS of VIP and Executive Program members do not have a period of validity; they are not deleted, as long as the member maintains his/her status level. As soon as the member loses the status of a VIP or an Executive Member, the unused PINS are not extended or compensated in any other way, and they are deleted on the day when three years from the earning day have passed.

8. Maintaining the status of a VIP and an Executive Member

8.1 To maintain the status of an Executive Member after a year from obtaining it, during the next qualification year the Executive Member should make 25 one-way flights with airBaltic or earn 20,000 status PINS. If the necessary number of flights or status points is not reached, the member loses the Executive status.

8.2. If the Executive status is maintained for another year, the member receives a renewed Executive Card that is valid for a year from the day of qualification. If the status is lost, a new personalized termless standard PINS Card is sent to the address specified in the member’s application form.

8.3. To maintain the status of a VIP Member after a year from obtaining it, during the next qualification year the VIP Member should make 50 one-way flights with airBaltic or earn 40,000 status PINS. If the necessary number of flights or status points is not reached, the member loses the VIP status and receives the Executive Member status.

8.4. If the VIP status is maintained for another year, the member receives a renewed VIP Card, which is valid for one year from the day of qualification. If the status is lost, a new personalized termless standard PINS Card is sent to the address specified in the member’s application form.

9 Taxes, Surcharges, and Service Charges

9.1 As far as flights purchased with PINS are concerned, the Member will be liable for any additional costs such as taxes (e.g. airport taxes and fees, security check fees, delivery fees), additional fees (e.g. insurance cover), as well as service fees (e.g. reservation amendment fees), unless otherwise specified by the Partner. 

10 Violation of the Terms and Conditions, Termination of Membership, Program Updates

10.1 The Member is entitled to terminate the program membership at any time by informing PINS.CO thereof in writing. The Member will have one (1) month from the date of dispatch of the notice of termination within which to spend the accrued PINS, after which the remaining PINS will not be credited or compensated for in any other way. PINS are not transferable.

10.2 PINS.CO may terminate the Member’s participation in the Program with immediate effect if:

10.2.1 the personal data disclosed by the Member are incorrect or inaccurate and they are not corrected within a reasonable time after receiving PINS.CO' request to do so;

10.2.2 the Member unlawfully registers another person to the Program; 

10.2.3 the Member misuses or tries to misuse the service, e.g. seeking to obtain an undue economic advantage for himself or for a third party;

10.2.4 the Member otherwise acts contrary to these Terms and Conditions or applicable laws; or

10.2.5 the Member causes damage to PINS.CO, its Partners, and/or other Members of the Program through his acts or omissions.

10.3 If PINS.CO terminates the Member's membership in accordance with Article 10.3.1. above, the Member will, however, have one (1) month from the date of termination within which to spend the accrued PINS. In the cases referred to above in Articles 10.2.2 - 10.2.5, PINS.CO reserves the right to freeze the Member’s Account and to immediately cancel the said Member's PINS. PINS.CO will then inform the Member in writing of the termination of the PINS Membership, the reasons thereof, and the cancellation of the PINS. 

10.4 When PINS.CO has terminated the Member's membership in the Program, it can no longer be continued.

10.5 If a Partner terminates its cooperation with PINS.CO, the PINS accrued for the Partner's products/services will remain in the Member’s account until their expiration.

10.6 PINS.CO reserves the right to cancel the Program at any time or to replace it with another program. PINS.CO seeks, if possible, to inform the Members of the termination or replacement of the Program no later than three (3) months in advance. In the above-mentioned cases, PINS.CO has the right to transfer the membership to a third party offering a replacement program or in connection with a business transfer, unless otherwise provided for in applicable mandatory legislation. In addition, PINS.CO always has the right to transfer the membership within its group, if it is justifiable for reasons related to the Program, the production thereof, or other related commercial reasons.

11 Data Protection

11.1 The registrar of the personal data gathered under the Program is PINS Finland Oy. The gathered data is processed in accordance with the Finnish Personal Data Act, the Act on the Protection of Privacy in Electronic Communications, and any other applicable laws in the manner described in the Program's data protection report. The data protection report is available for review on the Program's website as well as in the Program’s relevant places of enrolment.

12 Miscellaneous

12.1 The Member must use and store the Card with care. The Member should make every effort to protect the card from high temperatures, electromagnetic effects, and mechanical damage.

12.2 If the Card is lost, stolen, damaged, or used by another person without the Member’s consent (or if the Member’s Account is used by another person), the Member shall immediately inform the PINS Customer Service of it. The Member will remain liable for any attempts to use the Card or the account information until the PINS Customer Service has been informed of the matter. A new Card will be issued free of charge.

12.3 PINS.CO has the right to unilaterally change or supplement these Terms and Conditions, if necessary, by informing the Members well in advance in the Online Service or by other appropriate means. Such changes and additions will be deemed to have been approved, if the Member continues his participation in the Program. If the Member does not agree to the changes in the Program, he may cancel his membership in accordance with Article 9.1 of these Terms and Conditions. 

12.4 New Partners may come into or existing Partners may leave the Program, the products or services entitled for PINS or the amount of PINS accrued therefrom may change, or the selection of products or services offered as rewards or the amount of PINS required for them may be changed. Changes of the above kind are part of the maintenance and development of the Program, and they are carried out unilaterally by the decision of PINS.CO and/or Partners. Unless otherwise decided by PINS.CO in an individual case, the Members are not separately notified of any changes of the above kind. Timely information is made available to the Members in the Online Service.

12.5 PINS.CO is not liable for any indirect damage suffered by the Member in relation to or in connection with the Program, unless the damage has resulted from PINS.CO' intentional or negligent actions. PINS.CO' maximum liability is limited in each case to the euro value of the PINS collected by the Member suffering the damage during the six (6) months preceding the damage.

13 Applicable Law and Jurisdiction

13.1 The Program and these Terms and Conditions are governed by Finnish law. 

13.2 If any of the foregoing terms and conditions are not legally valid, in whole or in part, it does not affect the validity of the other terms and conditions. These terms and conditions cannot be used to derogate from the Member’s rights under the mandatory consumer protection provisions.
